TERMS & CONDITION of RENTAL
1. BOOKING, PAYMENT TERMS & PAYMENT METHODS
Rental enquiries can be made by Telephone, email,or fax.
1.1 To proceed with a reservation The Renter must complete booking form
(please contact owner) giving particular details of the number in
party,(adults, children & any special needs/requirements)
1.2 To confirm a booking from the UK , The Renter must return the
completed booking form with a Non-refundable deposit of £300/ US$350 for
each Week booked. This can be paid by Visa, MasterCard or cheque
(cheques should be made payable to D.S Booth & mailed to the address at
the bottom of the booking form.For Renters making bookings from EEC
country, USA or any other countries the completed & signed booking form
must be accompanied by a US$ cheque, VISA or MasterCard details for the
Amount specified above. A booking can only be considered confirm when
funds have been cleared by the Owner's bank. On receipt of the above The
Renter will receive written confirmation of the booking. If there are
any amendments to the agreement then The Renter must notify The Owner
immediately. Failure to do so could result in the booking being
cancelled.
1.3 A provisional booking can be held for a period of 5 (five) days. If
no booking form or cheque has received by the Owner after this period,
the booking will be will be released.
1.4 The balance of monies shall be payable in full to the Owner, 8 weeks
prior to departure start date of the Rental period. This can be made by
VISA,MasterCard. If payment is by cheque then 9 weeks Prior to the start
of the rental period
1.5 Any bookings make within a 9 week period must be paid in full at
time of booking. The minimum booking period is one week (7 days) Unless
special arrangements have been made withThe Owner.
1.6 A Security Deposit of £300/ US $350 is required against any loss or
damage and is payable with the Renters final payment 8 or 9 weeks prior
to departure. THIS DEPOSIT IS REFUNDED TO THE RENTOR IN FULL no later
than 4 weeks after the end of the Rental Period provided that the
Owner’s Management Company’s report shows that no loss or damage has
occurred and that the Property has been left in a good and reasonable
condition.
2. CANCELLATION
2.1 The Renter is entitled to cancel their booking at anytime: this must
be in writing. Cancellations made are subject to the following
conditions:
• The rental deposit made to secure the booking is non-refundable.
Cancellation’s made afterthis payment will result in forfeit.
• Cancellations made between 60 & 30 days from the rental start date
will result in a cancellation charge of 60% of the total rental price.
• Cancellations made 30 days from the start of the rental period will
result in a cancellation charge of 100% of the total rental price.
NOTE: The security deposit is fully refundable on cancellation.
3. BOOKING ALTERATIONS BY THE RENTOR
3.1 If the Renter wishes to make alterations to the booking at any stage
up to the rental start date The Owner will make every effort to assist
with his/her request. However,there may be a charge of £30/$45
3.2 Alterations to a booking 9 weeks before the start of the rental
period may be treated as a cancellation and as such be subject to
cancellation charges as outlined in 2.2
4. CANCELLATION BY THE OWNERS
4.1 In the event of cancellation by The Owners The Renter will receive a
full refund of all monies paid.
5. ACCOMMODATION AT THE VILLA
5.1 The villa can only accommodate the maximum number of people
stipulated on the booking form. When completing the booking form The
Renter must state clearly the number of people staying at the villa
during the rental period. Any alterations to the number of guest must be
put in writing to The Owner no later 14 days prior to Departure. Any
guests added after this Period will be subject to a charge of £100/$158
per person.
5.2 Sub-letting, assigning or sharing is strictly prohibited.
5.3 Renters must be over the age of 21. Any person(s) under 21 must be
accompanied by an adult. No bookings can be taken in the name of a
person under the age of 21. Parties of Renters under the age of 21 are
strictly forbidden and the Owners Agents are authorised to ask for
formal identification & if found to be underage will be asked to leave
the villa immediately and without refund.
5.4 The Villa will be made available for Renters At 4.00 pm (local time)
on the day of arrival and must be vacated by 10.00am (localTime) on the
day of departure. Arrivals earlier than 4.0pm or departures later than
10am will be charged an extra days rental.
6. SWIMMING POOL AND SPA
6.1 Children must be accompanied by a responsible adult when near water.
It is strictly forbidden to leave children unaccompanied in the swimming
pool or the spa at any time The Owners accept no responsibility or
liability for any loss to property or person(s)or for injuries sustained
by person(s) whilst in the pool or spa.
6.2 No bath oils, shampoo, bubble bath or similar substances are to be
used in the spa or the pool. Guests are asked to shower and remove
suntan oils etc before entering the pool or spa.
6.3 No glass jars, bottles, glasses etc are to be Used in or around the
pool and spa area. This is for The Renters own safety and the safety of
others in the party.
6.4 Any damage by The Renters to the pool, spa or the surrounding areas
caused by negligence or non adherence to the rules set out above and
those under heading USE OF UTILITIES will be liable for the full cost of
the repairs or damage including labour costs.
7. LOSS, DAMAGE, UPKEEP AND CONDITION OF VILLA
7.1 The Owner’s Management company have full Authority on-site in the
Owners absence. Immediately following the departure of the Renters, the
Management Company will check If the Villa has been left in a reasonable
state Of tidyness and cleanliness with no damage or loss of inventory
If, in the opinion of the Management Company the Villa has been left in
an excessively dirty or untidy, or damaged condition, The Owners reserve
the right to charge the Renter in whose name the booking was made all
costs incurred in order to restore the Villa back to its original
condition at the start of the rental term.
7.2 If the costs for the above reinstatement (7.1) exceed the rental
security deposit The Owner shall be fully reimbursed by The Renter whose
name appears on the booking form with 7 days of departure see 1.7)
8 INSECTS, BUGS AND PESTS
8.1 The Owner takes all possible action to Irradicate insects, bugs and
pests. The Villa receives monthly treatment both inside & out by a
reputable contractor as recommended by the builder. A certain amount of
bugs, pests & insects are inevitable in a climate like Florida and are
considered acceptable in small amounts. Only when in The Owners opinion
or on the recommendation of the Management Company will further action
be taken.
9. PERSONAL BELONGINGS, TRAVEL DOCUMENTS etc
9.1 Passports, Visa, Airline Tickets, Money, Travellers cheques, credit
cards etc are Strictly The Renters responsibility. The Owners Have no
liability or responsibility for loss in relation to any of the above.
Neither do they take representation or provide advice orally, in writing
or otherwise in relation to any of the above. It is the Renters
responsibility to make sure that the correct documentation is in place
for entry into the United States. All members of a party are strongly
advised to contact the US Embassy prior to travel to ensure the Correct
documentation is in place.
10 SMOKING AND LIVESTOCK, ANIMALS AND PETS
10.1 For the comfort and safety of all our guests NO SMOKING IS ALLOWED
INSIDE THE VILLA. NO ANIMALS, PETS OR LIVESTOCK ARE PERMITTED INSIDE THE
VILLA.
11. COMPLAINTS, SUGGESTIONS OR RECOMMENDATIONS
11.1 In the event that The Renter has any reason for complaint or
dissatisfaction, they should first contact the on-site Management
Company who will endeavour to solve the problem. It must be pointed out
that if the Management Company are called out to a complaint and in
their opinion the call was ‘unwarranted or Unjustified’ then a charge of
£55/$80 will be asked for from the Renter in advance.
12. OWNERS LIABILITY LIMITATION & FORCE MAJEURE
12.1 The Owners accept no responsibility for and shall not be liable in
respect of any loss or damage or alteration, delays or changes arising
from Circumstances outside of their control such As war, fire or adverse
weather conditions Government action, techincal problems with Transport,
closure or congestion at airports,Cancellation or change of schedules by
Airlines, theft from the Villa premises (both Interior and exterior
including garage, pool And spa areas). In the event that weather
Conditions fall above 50 degrees centigrade The pool heating will shut
off to prevent Damage. No refund will be given in these Events.
12.2 In the event that the Owners be negligent and/or In breach of
contract with the Renters Our liability shall be limited to the cost of
the Renters booking with The Owners.
12.3 The Owners accept no responsibility in Respect of any loss or
damage for which The Renter are or should be insured or Entitled to
indemnity from any third party.
13 ACCURACY OF INFORMATION
13.1 The Owners have taken care to ensure that the acuracy of
information they have provided. However Facilities and services may not
be open or available due to renovation or repair or maintenance
works,adverse weather etc. Wherever possible The Owner will elect to
advise of any Information available to them and pertaining to the above
and will take steps to notify the Renters prior to travel.
13.2 Some fixtures, fitting and furniture in the villa May also differ
from that advertised and The Owners reserve the right to reasonably
change or amend these as well as any of the Terms & Conditions set out
herewith.
13.3 Electronic, audio visual equipment or computer equipment setting
must not be altered or tampered with.
ADDENDUM
14. DEDUCTIONS FROM SECURITY DEPOSIT
14.1 KOOL AID drink causes indelible staining to Fabric and carpets. Any
staining, which may occur as a result will be deducted from the security
deposit.
14.2 Bleach or bleach products should not be used in the villa. Towels
and linen should not be washed in powder containing bleach nor should
washing bleach be used in the washing machine.
14.3 Only beach towels should be used around the pool area. These are
kept in the bathroom situated between the twin bedrooms. Please do not
used bathroom towels around the pool area.
15. THE GYM & GAMES ROOM15.1 Guests using the Gym and Games room
equipment do so at their own risk. Tampering with the equipment is
STRICTLY FORBIDDEN. Children under 18 are not permitted to use the
equipment and must be supervised at all times. Small children are
STRICTLY FORBIDDEN to use or play on or around the equipment.
